Terms of service

Version in force on 25 August 2026

1. Seller's identity and scope

These general terms and conditions of sale and services (the ‘Terms’) govern orders concluded with POWER LAB SARL, a private limited-liability company incorporated under Luxembourg law and trading as « POWER Print », whose registered office is at 144, Zone Industrielle Schéleck 1, L-3225 Bettembourg, Luxembourg, registered with the Luxembourg Trade and Companies Register under number B200913 and identified for VAT purposes under number LU28020230.

Contact: contact@power-print.eu – +352 691 260 215.

The Terms apply to the products and services offered on power-print.eu, by quote or through any other POWER Print ordering process. ‘Customer’ means any person placing an order. ‘Consumer’ means a natural person acting for purposes outside their trade, business, craft or profession. Provisions expressly reserved for consumers do not apply to business customers.

The essential characteristics, customisation, quantities, price, charges, lead time or delivery date and any special conditions are stated on the relevant product page, quote, order summary and/or proof for approval. In the event of a conflict, expressly accepted special conditions prevail over these Terms solely in respect of their subject matter.

2. Products, customisation and Customer files

POWER Print offers, in particular, printing, branding, cutting, production and customisation products and services configured according to the Customer's choices, measurements, wording, images, logos, files or other instructions. Photographs and presentation mock-ups are illustrative; the expressly agreed characteristics and approved BAT define the order.

The Customer must submit complete, accurate and technically usable information and files. POWER LAB SARL may request a higher-quality file or identify a technical difficulty before production.

The Customer declares that they hold the necessary rights and permissions for all wording, photographs, drawings, logos, trademarks and other elements submitted. The Customer authorises POWER LAB SARL and, where necessary to fulfil the order, its subcontractors to use them solely to prepare the BAT, produce or arrange production, inspect and deliver the order. POWER LAB SARL may refuse content that is manifestly unlawful or manifestly infringes third-party rights.

3. Quotes, orders and formation of the contract

Quotes are valid for the period stated in them. Before confirming an order, the Customer can check the summary and request correction of any errors.

The order request is submitted when the Customer expressly accepts the quote or confirms the ordering process, accepts these Terms and, where required, pays the specified deposit or price. Unless a binding quote provides that its acceptance is sufficient to form the contract, the order becomes binding when POWER LAB SARL confirms it on a durable medium, generally by email. The final order button or action states unambiguously that the order entails an obligation to pay.

Before the contract is formed, POWER LAB SARL may refuse a request for a legitimate reason, particularly where essential information is missing, production is technically impossible, content is manifestly unlawful, a payment incident has occurred or the request is incompatible with the stated capabilities. After the contract is formed, performance may be suspended only under the conditions of the contract and the law. Sums received for a refused request are refunded, except for an amount corresponding to a service already validly performed with the Customer's agreement.

4. Price and payment

For a Consumer, prices are stated in euros inclusive of all taxes. For a business Customer, a quote may be stated exclusive of tax, with applicable VAT added. Delivery charges and any additional charges are communicated before the order is concluded.

The applicable price and payment schedule are those in the accepted quote or summary. The payment methods actually available are stated on the quote, invoice or payment interface before the Customer commits. No payment method that has not been offered may be required.

Unless the quote states otherwise, production may be conditional on receipt of the amount due. Products remain the property of POWER LAB SARL until payment in full, without changing the rules on transfer of risk applicable to consumers.

5. Proof for approval (‘BAT’)

Before any printing or production begins, POWER LAB SARL sends the Customer an identified and versioned proof for approval. Production begins only after the Customer has expressly approved the BAT, using the function provided on the website or in writing. Silence by the Customer never constitutes approval.

The Customer must carefully check every element shown on the BAT, including the wording, spelling, contact details, dates, quantities where shown, dimensions, positioning, orientation and graphics. Any issue or correction must be reported before approval.

The approved BAT forms part of the contract and is the production reference for the elements that it expressly represents. If there is a conflict between an earlier instruction and the approved BAT, the latter prevails for those elements.

Unless a contractual colour proof is expressly agreed, a BAT viewed on screen primarily approves the content, dimensions and layout; the display of a colour may vary according to the screen, material and production process. Any specific technical cutting, format or colour tolerance enforceable against the Customer must have been communicated before the order or, where it can be determined only during pre-press, clearly submitted to and expressly accepted by the Customer before the BAT is approved.

Subject to statutory guarantees, POWER LAB SARL is not liable for an error in an element supplied by the Customer and faithfully reproduced on the expressly approved BAT. Approval of the BAT does not, however, constitute a waiver of statutory guarantees or acceptance of a production defect, transport damage, deviation from the BAT or error attributable to POWER LAB SARL.

Production may begin immediately after approval. A change is therefore not guaranteed. Where it remains possible, it may require a new quote, new BAT and new lead time. POWER LAB SARL retains the approved version and proof of its approval.

6. Production and lead times

The production lead time begins when POWER LAB SARL has all the necessary elements: a validly concluded order, receipt of payment due, usable files and information, and an approved BAT. Any delay by the Customer in supplying these elements postpones the stated schedule accordingly.

The applicable date or lead time is communicated in the quote, summary or order confirmation. If no lead time has been agreed with a Consumer, delivery takes place no later than thirty days after the contract is concluded. If a delay occurs, POWER LAB SARL informs the Customer, and the Consumer's statutory rights, including those enabling the Consumer to require performance and then, under the conditions provided by law, terminate the contract, remain applicable.

7. Delivery and transfer of risk

The areas served, delivery methods, restrictions and delivery charges are stated before the order in the quote or ordering process. The Customer must provide a complete, accessible address and check the parcel upon receipt.

For a Consumer, the risk of loss or damage transfers when the Consumer or a third party designated by them takes physical possession of the product. Where the Consumer, on their own initiative, entrusts delivery to a carrier not offered by POWER LAB SARL, risk transfers when the product is handed to that carrier.

If a parcel is visibly damaged, the Customer is invited to record specific reservations with the carrier and promptly contact POWER LAB SARL with photographs. Failure to record reservations or report the issue immediately does not remove the Consumer's statutory guarantees.

If delivery fails because of an incorrect address, repeated absence or an unclaimed parcel attributable to the Customer, the actual cost of resending may be charged after prior notice.

8. Customised products: no right of withdrawal

In accordance with Article L. 222-9 of the Luxembourg Consumer Code, the fourteen-day right of withdrawal does not apply to goods made to the Consumer's specifications or clearly customised. Consequently, no return, exchange or refund for a simple change of mind is accepted for these products once the customised sales contract has been concluded, including where production has not yet begun.

This exclusion does not affect statutory guarantees or the Customer's rights where a product does not conform to the approved BAT, has a production defect, contains an error attributable to POWER LAB SARL or was damaged in transit.

For a standalone service that is not inseparable from the supply of a customised good and does not fall under another statutory exception, the Consumer has fourteen days from conclusion of the contract to withdraw. Notification can be sent in accordance with Article 9 and using the attached form.

The service begins before the end of this period only at the Consumer's express request. If the Consumer withdraws after requesting that it begin, they remain liable for the amount proportionate to the service provided up to withdrawal, where provided by law. Loss of the right of withdrawal before the period expires requires the service to have been fully performed, with the Consumer's prior express agreement and acknowledgement of that loss.

9. Non-customised products: Consumer's right of withdrawal

If POWER LAB SARL exceptionally sells a standard product that is neither made to the Consumer's specifications nor clearly customised, the Consumer has fourteen days from receipt to notify the decision to withdraw, without having to give a reason.

Notification can be sent using the form at the end of these Terms or any unambiguous statement to contact@power-print.eu or to POWER LAB SARL, 144, Zone Industrielle Schéleck 1, L-3225 Bettembourg, Luxembourg. The product must then be returned without undue delay and no later than fourteen days after notification, to the return address provided by POWER LAB SARL. The direct cost of return is borne by the Consumer unless otherwise stated. For a product that cannot normally be returned by post, the direct cost of return or an estimate of that cost is communicated before the order.

POWER LAB SARL refunds payments received, including standard delivery charges, within fourteen days of notification. It may defer the refund until it has recovered the product or received proof of dispatch. The refund is made using the same payment method unless expressly agreed otherwise. The Consumer may be liable for any diminished value resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the product.

10. Statutory guarantees and complaints

The Consumer benefits from the statutory guarantee of conformity for two years from delivery. This guarantee also applies to customised products. A defect appearing within twelve months after delivery is presumed to have existed at the time of delivery, unless proved otherwise or unless that presumption is incompatible with the nature of the goods or defect. Under the conditions provided by law, the Consumer can have the product brought into conformity by repair or replacement, free of charge, within a reasonable period and without major inconvenience. Where the statutory conditions are met, the Consumer can obtain a price reduction or terminate the contract. Rights relating to hidden defects also remain applicable.

A product that differs from the approved BAT, has a production defect or was damaged before the transfer of risk may give rise to a complaint. An error supplied by the Customer and clearly visible on the approved BAT is not, in itself, a production defect; this rule never covers a production discrepancy or an error attributable to POWER LAB SARL.

To facilitate processing, the Customer is invited to write to contact@power-print.eu stating the order number, BAT version and, where useful, including photographs. This invitation creates no limitation period and restricts no statutory right.

11. Liability and force majeure

Each party is liable for direct damage resulting from its breaches, under the conditions of applicable law. Nothing in these Terms limits the Consumer's mandatory rights, liability for fraud or gross negligence, or liabilities that cannot be excluded by law.

POWER LAB SARL is not liable for a delay or failure to perform caused by an event reasonably beyond its control that meets the legal conditions of force majeure. It informs the Customer as soon as possible and endeavours to limit the consequences. The Consumer's rights under mandatory provisions remain reserved.

12. Intellectual property

Rights to content supplied by the Customer remain with their owner. POWER LAB SARL is granted no right to publish or use that content or the customised product for promotional purposes without separate authorisation.

Unless the quote provides otherwise, tools, templates, methods, rejected graphic proposals and working files created by POWER LAB SARL remain its intellectual property. Delivery of a printed product does not transfer these elements.

13. Personal data

POWER LAB SARL processes the data required for quotes, orders, payments, BATs, production, deliveries, accounting obligations, after-sales service and dispute management. Detailed information on purposes, legal bases, recipients, possible transfers, retention periods, the handling of BATs and print files, data-subject rights and complaints to the CNPD is provided in the Privacy Policy.

14. Complaints and consumer mediation

Any complaint must first be sent to contact@power-print.eu in order to seek an amicable solution.

If this step is unsuccessful, the Consumer may contact the Service national du Médiateur de la consommation, 6 rue du Palais de Justice, L-1841 Luxembourg, email: info@mediateurconsommation.lu, website: mediateurconsommation.lu. Participation in mediation is based on the parties' agreement; POWER LAB SARL will inform the Consumer, on a durable medium and in accordance with the law, whether it agrees to participate in the procedure. Recourse to mediation does not deprive the Consumer of the right to bring proceedings before the courts.

15. Governing law and competent courts

Contracts are governed by Luxembourg law. This choice does not deprive a Consumer residing in another country of any more protective mandatory provisions of their country of residence that would apply. The competent courts are determined by the applicable legal rules; nothing in these Terms deprives a Consumer of the right to bring proceedings before a court with jurisdiction under those rules.

Solely for contracts between businesses, and after an attempt at amicable settlement, the courts of the judicial district of Luxembourg have exclusive jurisdiction, unless a mandatory provision provides otherwise.

16. Evidence, retention and changes to the Terms

Electronic communications, accepted quotes, confirmations, payments, versioned BATs and approvals retained under conditions ensuring their integrity may be used as evidence. The Customer receives or can retain the Terms applicable to the order on a durable medium.

The applicable version is the version accepted when the order is placed. A subsequent amendment to the Terms does not apply retrospectively to orders already concluded. If a clause is declared invalid, the other clauses remain applicable to the fullest extent permitted by law.
